HELP! The forsworn Conspiracy!

So I am playing the task "The Forsworn Conspiracy" and I have met the guards in the temple, who then threw me in jail. Fine enough.

 

The problem is - I have to get the orc a shiv - BUT I ALREADY GOT THE SHIV WHEN I WAS IN JAIL EARLIER - BEFORE I MET THE GUARDS AT THE TEMPLE. SO I CAN'T GET IT AGAIN?!

 

what do I doooooo? ): I tried fight the orc like .. 5 times but he and the other prisoners keeps killing me..

I tried see if I could go to mine, leave the shiv, get arrested and then find it that way ... but then it was gone ...

 

so seriously ... what do I do?! ):

I play on a Playstation 3!

That's "No One Escapes Cidhna Mine," not "The Forsworn Conspiracy."

 

Check out this page. There are numerous ways to bypass getting a shiv. Also, an NPC gives you the shiv, so I don't think it was possible to get the same one prior to this quest. It should still be available.

That site doesn't help ): I have been reading the entire page, but nothing about how I can continue when I can't kill the orc or persuade him ):

You can always go into your settings and turn the difficulty all the way down for the orc fight, and then just reset it after.
